On June 27, 2023, a lawsuit was filed in federal court on behalf of Local 371 members who are employed by the Administration for Children’s Services in the titles of CPS, CPSS I and CPSS II. The case is titled Benjamin, et al v. The City of New York and over 2400 workers have already joined the case.

This case is similar to the previous overtime pay lawsuits, Foster, et al v. The City of New York and Williams, et al v. The City of New York, brought under the federal law, the Fair Labor Standards Act (FLSA) seeking damages for uncompensated overtime work (pre-shift, post-shift and meal period work), late payment of overtime, and overtime pay calculated at the wrong rate (for ex., not including night shift differential and meal allowance payments). The Foster and Williams cases proved that the City violated the FLSA by not properly paying CPS/CPSS I/CPSS II overtime and resulted in multi-million dollar settlements paying out significant damages to over 3000 members.
